Cracks in the Foundation Of American Political Institutions

You have to admit that if you were Daniel Silva or Tom Clancy trying to write another international thriller you could do no better than the opening chapter being devoted to the Russians hacking American political campaigns in order to influence elections and plant their own Manchurian candidate. This opening “staging” chapter could include tensions between the intelligence services and the new president complete with allegations and embarrassing verbal exchanges. To listen to the president elect and the heads of the security agencies trade public accusations and barbs along with charges of incompetence is unprecedented.

And what if rather than treating this as an enjoyable fictional experience we stopped for a moment and considered the implications for the current state of American institutions, political leadership, and security. Corey Robin has begun to make the argument that American institutions are becoming less and less legitimate and this is occurring against the background of political deterioration. Even at the risk of charges of alarmist exaggeration, I believe it’s possible to make the case, at least one worthy of discussion, that there has been a steady decline down a path littered with the remnants of more legitimate institutions and behavior reflective of that legitimacy.

The American democracy seems to be turning on itself and in the process weakening institutions and altering our sense of moral political consciousness. In other words, certain democratic values and forms of political communication have begun to decline. Robin cites as one early example the loss of trust in the government and military during the Vietnam War that resulted from lies and misleading information. This would extend to the crude manipulations about Iraq and the deceptions perpetrated on the American people about the presence of weapons of mass destruction, the denigration of an admired military leader (Colin Powell), a “stolen” election (Busch-Gore) decided in accordance with pure party lines by the Supreme Court, the rise of Trump, and a Congress so polarized and entrenched that it cares nothing about governing but plenty about treating the other as an enemy to be conquered rather than a worthy adversary to work with.

There are two trends in contemporary American society that are both causes and consequences of this decline. The first is the rise of American authoritarianism (see Amanda Taub’s work), and the second is the post-truth politics were there are no facts or evidence-driven conclusions that can’t be manipulated. As Nietzsche put it, “there are only interpretations.” And it is important to underscore that the rise of authoritarianism in America is not about strong controlling individuals taking over and leading by authority. No, it is more the rising tendency for people in the country to obey and accept authority, to prefer authoritarian relationships. They accept authority unquestionably and seek it out.

This preference for authority was one of the divides that separated Trump supporters from those who are horrified by him. And a post-truth mentality seems to be attaching itself and boring into the culture ready to deconstruct and disperse the “reality-based community.” These are the conditions for some difficult conversations and the impossibility of communicating. Then again, paradoxically, it is probably only the communication process that can re-challenge these trends.

What madman or anguished society would give the keys to the candy store we call the United States to Donald Trump? No candidate in history has been less prepared and, moreover, does not seem to be bothered by it. His cabinet and advisor appointees make for a ghoulish monster’s ball of Wall Street billionaires who have no experience in government, business executives who think running the government is the same thing as running a business, and ideologues with an agenda that is ironically counter to the mission of the office they are running.

Trump’s election has been regularly compared to populist movements in history and currently around the world. It is in line with populist and nationalistic parliaments in Hungry, Poland, Greece, and the rise of the right in France. And the rhetoric of populism is consistent across cultures. Such rhetoric is often an early indicator of unstable and vulnerable democracies. Truly consolidated democracies are the most resistant and stable forms of government and most likely to be immune to the siren call of nationalism and populism. But less established democratic political cultures, especially those with charismatic strongmen as leaders, are more susceptible to the political discourse that constitutes populism.

That is, the modern populist praises tough and decisive leadership, belittles and distrusts elites and specialists in an effort to alienate the average person from the truly competent, and is critical of institutions. Trump, interestingly, has some new wrinkles for this pattern because although his rhetoric strikes a chord with the struggling and downscale demographics, he has successfully convinced them that he will improve their lives. Curiously, Trump traffics in elitism. And he will soon go about the business of using his own appointees as loyalists who will compromise the media, silence the opposition, and create a threatening discursive environment.  He has already begun to undermine trusted institutions such as the CIA (taking the unprecedented position that the CIA is wrong about Russian cyberhacking), the media (a regular flow of criticism and delegitimization that cast even more doubt on quality sources of information), the legislative history of conflict of interest policy (refusal to release tax forms, challenges to his own business interests), and foreign policy traditions (a more volatile and aggressive foreign policy such as breaking the nuclear treaty with Iran, harsh challenges to China, and name-calling).

The United States’ record of promoting liberalism and generally making the right decisions is strong enough. We commit our military when necessary; typically pass legislation that protects the rights of individuals (whether it be guns or abortions); we continue to make progress on due process and equal protection under the law; and we have a decent history of widening the circle of citizen inclusion with respect to rights and opportunities.

But we momentarily lost our minds when we voted for Trump. It was a reckless mistake that requires a “do over.” Clinical research explains that for successful suicide victims there is only a few seconds in which they will actually pull the trigger or jump. The rest of the time they are holding back but there remains some moment – some brief period when the window is open – in which all of their stress, pressures, and cognitive distortions conflate and they actually step off the ledge or pull the trigger.

So we have the United States and Trump. The American citizenry momentarily lost its mind and pulled the trigger. It’s going to be a crazy few years riddled with mistakes resulting from Trump’s lack of preparation, his long and embarrassing record of bad behavior and misogyny, his refusal to listen to security briefings because he can lone wolf-it, his knee-jerk congenital lying (his loss of the popular vote by almost 3 million was from people casting illegal votes; Russia had nothing to do with hacking or influencing the American election), and his naïveté about world leaders.

I fully expect Trump to expand his control and throw the population a bone or two on occasion, all the while converting the presidency into a postmodern spectacle designed to continue Trump brand recognition.

 

 

How Trump Misunderstands Islam

Trump continues to use fear appeals and scare tactics when it comes to Muslims and terror. And while he is minimally effective – and getting less so every day – his supporters are sympathetic others who are increasingly misinformed about terror and Islam. A piece of video footage showing Trump supporters at a rally had one fellow screaming at another that Islam was an “ideology.” The point was that Islam is a nefarious set of beliefs and practices designed to manipulate you into its belief system.

The dilemma here is that defining Islam as violent justifies an armed response when, in fact, the only response that will be effective is a long-term war of ideas pitting *Islamist extremism against liberal democracies. As Gutmann and Thompson have claimed in their highly recommended book Democracy and Disagreement,“of the challenges that American democracy faces today, none is more formidable than the problem of moral disagreement.” In other words, those who have sacred values and are what Scott Atran calls “devoted actors” rather than “rational actors” pose the biggest challenge to liberal democracies because conflicts over fundamental values are so resistant to resolution. You cannot simply subject the moral disagreement to the rational calculations of the marketplace.

But if wanton murder of men, women, and children is so fundamental to Islam why is it such a recent phenomenon on the world stage? Why doesn’t “jihadism” as it has come to be known have long history? Typically, Islamist terror is first associated with the 1979 Iranian revolution. But even the Iranian revolution can be analyzed as a clash of political ideologies where Islamists attach themselves to religious sounding terminology (“infidels,” “holy wars,” “party of God”) in order to give themselves religious justification.

It is true enough that Islamism is really a totalitarian movement that has hijacked some religious terminology in an effort to alter traditional Islam and challenge Western democracies. But Boroumand and Boroumand writing in the Journal of Democracy make the following emphatic statement and I quote in full:

“There is in the history of Islam no precedent for the utterly unrestrained violence of Al Qaeda or Hezbollah… To kill oneself while wantonly murdering women, children, and people of all religions and descriptions… has nothing to do with Islam and one does not have to be a learned theologian to see this… The truth is that contemporary Islamist terror is an eminently modern practice thoroughly at odds with Islamic traditions and ethics” (p.6).

I don’t mean to imply that traditional Islamic religious teachings hold an inclusive democratic vision for the world or that it resonates with contemporary ideas about liberal democracies and human rights. But the long view of any religious evolution has it moving toward a widening circle of inclusion and dignity for others. As of now, there are more than a few Islamic countries that are pluralistic but have no political concept of “pluralism.” For this reason they define rigid group boundaries and more nascent forms of control.

But as with most of the issues in this election, Trump is not the answer to anything.

 

*Terminology note: I use “Islamist” or “Islamism” to refer to those extreme groups or ideologies that justify violence and cherry pick the Koran to give their ideology a religious sounding façade. The term “Islamic” refers to the long political, religious, and scholarly tradition of institutional Islam.

Don’t be Fooled by Trump’s Use of Studied Sincerity

The video below is a dramatization (although not much of one) of “common sense” and part of its infrastructure, namely, “sincerity.” Donald Trump has been trying to capitalize on this deep-seated American value where “common sense” or “plain talk” or “telling it like it is” is glorified as the highest form of discourse. John McCain in 2000 termed his campaign tours as the “Straight Talk Express.” Bill O’Reilly’s “No Spin Zone” and the rhetorical technicalities of Bernie Sanders continue this effort to convince people that they are authentic and lack any pretenses. The Norman Rockwell image of the common man standing up to speak plainly is burned into our psyches and is an iconic image of communicative authenticity.

Well, I’m here to point out the dangers and the potential damage of this rhetorical shell game called “straight talk.” Trump is the worst perpetrator of this myth and he is successfully fooling millions into believing he is actually worth listening to. The assumption that one is “telling it like it is” or doing nothing but “talking straight” is a dangerous myth that weakens the quality of decision-making and directs attention away from substantive issues. Of course, for Trump directing attention away from substantive issues is just the point. Since he does not know anything about foreign policy, governance, or macroeconomics he has to redirect the conversation. Thus, he has spent his time trying to convince the populace that he is “sincere”.

Political communication is organized around language and symbols of various types so it is particularly important that we attend to words, their meaning, and how they are used. Otherwise we are confused about the state of political discourse and are likely to come to poor decisions. The myth of straight talk directs attention to a preferred ethical stance related to sincerity rather than the quality of reasoning. Sincerity is, of course, important because we do not want to believe our leaders or communicative partners are lying or manipulating us. But sincerity doesn’t have anything to do with the quality or truth value of what we are saying. You can “sincerely” say something stupid and inaccurate.

But it gets worse. Performing sincerity is designed to convince the listener that the source of the message is not only being truthful but also complete. The implication is that everything of importance and relevance is being said and nothing is left out. The speaker is providing all relevant information and nothing else is pertinent. This blunts the listener’s responsibility to pursue additional information. So when Trump says, “the economy is in terrible shape” (which it certainly and clearly is not) he wants you to accept that statement on the basis of his sincerity and not facts.

And it gets worse again. Convincing someone you are being sincere and speaking “straight” is designed to relieve the source of the message of any further responsibilities. The implication is you no longer need to inquire any further or challenge anything I have to say because I have “laid it all out.” It’s a way of saying a speaker is not responsible for what he says, and thereby sealing him from criticism, because he has fulfilled his responsibilities.

More than a few times I’ve heard people whom I know can barely pay their bills characterize the billionaire narcissist Trump as “telling it like it is” and a “man of the people.” To describe Donald Trump as “like the average guy” – meaning a sincere absence of artifice and symbolic trickery – means you have been thoroughly co-opted by the candidate’s studied sincerity.

Language and symbols are central to political communication, but so is critical inquiry. If leaders and political figures are going to be held responsible for their words, which is crucial to the democratic political process, then the capacities of the subject population must not be limited; it must be possible for them to interrogate leaders and satisfy truth challenges. Trump has skillfully convinced many to substitute his calculated sincerity for thoughtful critical inquiry. This can be dangerous and we have seen historical precedents for this danger.

Authoritarian States Are Not so Stable

I tend to be an unapologetic democracy advocate who is confident in the premise that elevates the essence of democracy (consent of the governed) to the most moral and ultimately stable form of government. Holding such a position can certainly get you in trouble if you convert it into neoconservative foreign policy and start meddling in the affairs of others under the justification of “democracy promotion.” Moreover, there are more than a few people who make the counterargument that democracy is destabilizing for cultures unprepared for it (many in the Middle East and Arab world), and authoritarian regimes may be on the wrong side of human rights but they are stabilizing. Beyond all the opinion on these matters, there is the problem of sufficient cases and empirical demonstration, namely, what are the instances where democracy promotion and advocacy actually work to undermine authoritarianism and can be credited with “democratic regime change.”

Gregory Gause has initiated excellent steps in this direction in a recent article in Foreign Affairs. You can find it here. Gause takes up the task of explaining the “myth of authoritarian stability.” The “Arab world” as he terms it sports a long list of authoritarian leaders – Qaddafi in Libya, the Assad family in Syria, Mubarak in Egypt, the al Saud family in Saudi Arabia, Ben Ali in Tunisia and others. And even though there are complex differences amongst these cases there seems to be, according to Gause, two issues that align themselves in such a way as to predict either the likelihood of authoritarian stability or democratic liberalization.

First, you’ll rarely find, if ever, an explanation that accounts for Arab regime stability in terms of culture. Most attribute stability to the relationship between the state and the military. Still, the assumption that there is no daylight between the military and rulers is not necessarily correct. There are cases where the military was protective of protesters and this was true of Egypt in particular. When societies are homogeneous and the military is not subduing an ethnoreligious minority they are more sympathetic to types of resistance. When the military is professionalized and mature they tend to be less implicated in automatic obedience to the regime.

Gause offers a second assumption about authoritarian stability which is the state control of the economy. Oil wealth, for example, built systems of patronage and provided social services that appeased the population. Salaries, subsidies, state created jobs, and various other social welfare programs are assumed to maintain authoritarian positions. But it turns out that attempts to modernize the economy have been more successful at enriching a few and creating opportunities and privileges for the upper classes composed mostly of the super wealthy and ruling families. Some authoritarian regimes are then quick to provide salary increases and other benefits for citizens, but have often been surprised at the extent to which groups are politicized and willing to foment rebellion.

Turns out, as Gause concludes, that authoritarian regimes are not so stable after all and many have underestimated the pressures for change lurking beneath the surface. These conditions make it tempting to interfere and try to manipulate the dynamics of change in authoritarian societies. But it’s important to remember that most basic dynamics are indigenous and outside states should tread cautiously.

 

 

 

 

 

Future Work in Deliberation Will Tackle the Problem of Religiously and Ethnically Divided Societies

The essence of deliberative communication One of the biggest tensions in both politics and culture is the balance between membership in an ethnic community and the sense of belonging it provides versus a more capacious mentality with respect to respecting democratic ideals of inclusiveness and fairness. Many current cultural and political problems trace their roots to multicultural situations and settings where social cohesion is lost as settings become more diverse. Consequently, politics is essentially about the management of differences. And one of the most difficult differences to manage is ethnic identity which offers a strong sense of belonging but is quite dumbfounded when it comes to developing intergroup cooperation and an identity sufficiently broad enough to include both sides of a conflict.

The “received” deliberative democracy literature is mostly broad and normative focusing on abstractions about how to reconcile differences in a democratic manner. But one of the underappreciated difficulties of the more theoretical approach to deliberation is that it fails to sufficiently embrace the matter of power asymmetries. These are when values and interests are deeply entrenched and inequality is part of the natural state of affairs between two groups such that one side is economically and militarily superior.

The first and most important question is how one imagines deeply divided societies or groups coming together. Ethnopolitically divided societies might live near each other and tolerate a side-by-side existence, but they can’t share trust and a sense of community. The two sides must ultimately work to transform the context, the individuals, and their cultural differences in order to create a relationship rooted more in mutuality than rank group identification. On one level, this involves transforming identities – which is theoretically possible because identities are described as social constructions which means they can be constructed, deconstructed, and reorganized. This is the transformative and epistemic sense of deliberation which believes in the gradual process of creating new relationships and shared communities. Again, the question remains as to how this transformation happens. Or, what is the mechanism or interaction pattern responsible for achieving this new state of affairs.

Rigorous and serious deliberation is an antidote to communication based on bargaining, trading off interests, and manipulations designed to achieve private goals. Deliberation is about interest and preference formation. But in the case of deliberation for divided societies power asymmetries must be accounted for. In fact, it makes little sense to ignore just the defining issue that is the root of the conflict. Differences between divided societies are usually moral and cultural in nature but it is close to impossible to arrive at moral consensus between ethnopolitically separated groups. This is where what I call “Reasonable Disagreement” (Chapter 3 in my most recent book Fierce Entanglements: Communication and Ethnopolitical Conflict) can be helpful. Reasonable disagreement – the details of which are beyond the concerns of this posting – begins by treating the other not as an enemy but as an adversary as Iris Young argues. Reasonable disagreement is simply the assumption that there is more than one defensible way to make an argument or hold a belief. It recognizes that one group’s worldview is not necessarily or clearly superior or correct. There is simply no way to manage differences and develop cultural sensitivity between groups without their remaining gaps of meaning and understanding that simply must be tolerated.

Viewing the other side of a divided society as an “enemy” requires vanquishing him or her because the other side is typically considered wrong and worthy of annihilation (either literally or symbolically). “Adversaries”, on the other hand, are respected worthy opponents that cannot be thoroughly vanquished. Reasonable disagreement has two senses: the first is as a political value to be nurtured and developed in a democratic society. It is a foundational plank of the requirements for tolerance and diversity in liberal democratic societies. The second sense is as an epistemic value responsible for new and creative decision-making.

I think the challenges of ethnopolitically divided societies are going to be the subject of increasing research and theoretical attention in the future – and rightfully so.

 

 

 

The Republicans Are Wimps: How to Have a Deliberative Presidential Candidate Debate

 

10-commandments-of-LogicRemember, quality adversarial debate does not arise spontaneously. It is a public good that must be nurtured.

Is it really too much to ask that the political parties (but essentially the Republicans this year) work harder to turn even the primary debates into something a little more deliberative? These debates are structurally flawed and result in confusion and a cacophony of voices that are incoherent and fail to provide a line of reasoning for citizens to observe and learn from. Any debate structure put in place will have its strengths and weaknesses, but any structure will also be better than what we’ve been witnessing.

Running for president is not for sissies. You have to be able to stand up and respond to criticism and make your case to the public. And when attacked the candidate should, ideally anyway, respond with argumentative detail that demonstrates a full command of the issues. The Republican candidates who complained about “gotcha” questions and thought questions about one’s personal behavior and finances were out of line were more interested in manipulating the debate format into kid-glove treatment rather than vigorous engagement. If it seems like a candidate is going to bend under the pressure of a journalist asking him or her a “mean” question, then the candidate might have problems shouldering the burdens of the world.

The structure of the debates is consistent with the structure of the television medium. These 30 second time limits and response times are responsive to the commercial nature of television and the belief in the audience member’s limited processing capabilities. The debate format is not conducive to the engagement of complex issues such as Iraq, healthcare, gun control, race relations, and the like. Consequently, we get sound bite debates with simplistic images of “good guys” and “bad guys” who stand on the stage waiting for the right moment to insert a pre-prepared statement that is semi-related to the issue at hand and typically doesn’t advance an issue.

The 14 Republican candidates have the nerve to pose problematic and sometimes wild ideas such as deporting 10 million people, building walls to seal off immigrants, cutting a 70,000 page tax code to three pages, and then whimpering when they were challenged on these ideas. If these fringe Republican candidates get their way it will only be Fox News who gets to ask them softball questions.

Outline of a Deliberative Format

The following issues must be addressed in order to increase the communicative value of these debates and come closer to the commission’s goals for informing the public and fostering a truly deliberative environment. Read more about related issues in an article by Collier.

  1. The model of dialogue and reasoned deliberation has always expected the participants to be mutually joined and engaged in the same issue. In other words, they need to be talking about the same thing at the same time. Inserting canned and pre-prepared comments that are designed for nothing but manipulation and desperate attempts to make mini campaign speeches are an anathema to the dialogic and deliberative process.
  2. The Commission on Presidential Debates should first direct its attention away from what it believes to be its role in structuring debate formats and concentrate more on the constitutional right to receive information. This means structure the questions and the format of the debate so that specific controversial issues (gun-control, healthcare, the war in Iraq, fighting ISIS, taxes) receive required attention and time. The current debate structure deprives listeners of this information.
  3. There must be meaningful opportunities for response. As of now, no bad argument goes unpunished. There should be fact checkers working during the actual debate and candidates would be required to respond to discrepancies at a selected period of time at the end of the debate. These fact checkers could also provide additional context for misleading and manipulative quotes taken out of context.
  4. The opportunity to correct mistakes and challenge misleading comments is not trivial because unchallenged and uncorrected comments find a life of their own circulating in media discussion and among citizens. Lies, exaggerations, and out of context information becomes reified and assumes a truth value.
  5. A common strategy for aggressive campaign operatives is to make a false statement or accusation, uphold it for a couple of new cycles, and then disappear. Even if the statement is later shown to be a complete falsehood the damage has already been done to the opposing candidate. This “name-calling” tactic degrades the process and increases the magnitude of falsehoods circulating in the discourse.

I will have more to say on debates and their deliberative structure in future posts. But it would behoove us to keep in mind that citizens prefer to receive information from like-minded others. This causes distorted processing and polarization of the type we see today. It’s imperative that political candidates be exposed to a diversity of opinions in order to improve their own.

 

 

Is Ending History Possible?

I’ve always been a little bit partial to Francis Fukuyama’s argument that liberal democracies and market economies represent the natural gravitational pull for all political cultures. Fukuyama argued in his provocatively titled book “The End of History” that even the most repressive regimes could not escape sprouts of resistance that led to more democratic processes and freer markets. These were not only ideologically and economically superior but they were natural to humans. Of course, some pundits at the time suggested that this supposedly natural pull toward market economies and liberal democracies was grounds for repressive or oppressive behavior and would lead to a sort of conservative triumphalism that forced political systems on other cultures. The hard-core diversity stance also naturally resisted this argument suggesting that alternatives and variations were certainly possible.

Still, historical analyses and observations of pressures that emerge in political systems, not to mention a sort of inescapable common sense, make it difficult to escape the natural superiority of democratic processes and market economies. Given the advent of science, the Enlightenment, modernity, and the political and economic stability of Western democratic societies, it does seem like the world is evolving in that direction. It’s not that there are not branches and deviations (Pol Pot, Nazi Germany, Marxism) from this supposed march toward openness and democracy for the route is not a straight line. But it does seem to be the case that if we take a step backward we can over time take 1 ½ steps forward and on the average – even according to measurements of democracy around the world – continue to progress.

Then, we encounter ISIS. A nightmare from history that you thought we had awakened from centuries ago. Even after the US won the battle with communism and China turned its head toward capitalist practices the advent of ideologies like ISIS is a bracing reminder that maybe these democratic values are not so universal after all. Sometimes other cultures recognize the benefits of liberal democracies and free markets but they resent the preaching of the West and always feel a little humiliated and pressured by the United States. They sometimes reject liberal values simply because they are espoused by the US. Additionally, conservative sensibilities about the role of women, religion, and communicative rights make for common ground between authoritarian cultures like Russia and religious cultures in places like Africa or the Middle East.

Even the liberal advances of the West, which can be considered part of American exceptionalism, are relatively new and in some cases quite shallow. The US continues to hope that others will copy us, that they will see the errors of their ways. But waiting for others to simply “get it” will make for a pretty long wait. We don’t even know what it is we are asking them to copy. And it is true enough that we could turn this into a political scientist’s playpen with all sorts of theories, foreign policies, and suggestions on how to establish democratic sensibilities. But this doesn’t seem the best agent for change either.

The simple essence of democracy, which is popular sovereignty and individual rights, probably cannot be forced or imposed on anyone. There is an obvious logical contradiction here. How can democracy and individual rights be a “natural” evolution if it is being forced on someone? Surely it is best if such values emerge from inside political cultures but the counter forces of power and self-aggrandizement by a few can prevent the flowering of democracy for a long time – maybe forever.

It’s true enough that US preaching and heavy-handed manipulations may be counterproductive but that does not weaken the core value of democratic systems which is the notion of human rights, or that people have a right to legitimate participation in the political process. No society can hold together its multiethnic and multireligious subgroups without some sense of what it means to have human rights that are genuine and culturally authentic. Such authenticity is crucial because values forced by other cultures will always be resisted. Moreover, the attractions of nationalism and religious identity are powerful. They will be overcome only by something more powerful such as a social contract that guarantees the legitimacy of everyone’s participation, and the protected sound of their voice.

Israel as a Jewish State

Now that Netanyahu has formed a government, a very conservative one, it’s time to think about the “Jewish” definition of Israel. We can explore these issues and expose the difficulties and suffer the different philosophical consequences including the conundrums, logical impossibilities, and damning inevitabilities. Then I’m going to conclude that Israel should be Jewish, that the entire history of the country and the Zionist project makes little sense if Israel is not “Jewish.” You will see, of course, that according to some I’m recommending “Jewish lite” and that will be enough to disqualify my conclusions. But ultimately there’s only one way to meet that goal of Israel being both Jewish and operational and that’s for the Judaism to inform the state but not control it.

This question of Israel’s Judaism is really no small matter because it determines whether or not the state serves Judaism or Judaism serves the state. In other words, if the state is Jewish first and democratic second then the democracy has to be flexible enough to fit the Jewish nature of the state. Strongly religious Jews who want Israel to be a Jewish state begin with Judaism and shape all other forms of government to fit the needs of the Jewish community. Places like the United States begin with democracy and shape the society to fit the democracy. This is known as a liberal democracy and in the more pure sense is impossible in Israel if the state is “Jewish.” I would recommend a reading from the Jerusalem Center for Public affairs available here.

If Israel is devoted to Jewish particularity than it begs the question about what that particularity is and whether or not it is sustainable. A society that is truly communal in the sense that everyone holds a religious or ethnic identity is a society that is truly actualized and expressed by the state. The “state” is truly a full expression of the people and not simply a compromise or the sum of the parts. Even at the risk of some exaggeration the state becomes the full expression of the nature of the people. Now, we’ve seen all this before and it certainly wasn’t pretty (think Fascism or the Soviet Socialist Republic). But it is not inevitable that the state will gravitate toward authoritarianism and oppression – even though constant monitoring is required. But Israel will have trouble if it has a strong sense of Jewish identity wrapped up in the state because the community is not cohesive. An officially Jewish Israel will be oppressive for non-Jewish groups such as the Arabs. Again, this is a situation that simply cannot stand. Israel must find a way to be Jewish but acceptably tolerant of the groups within its confines that are not Jewish. It is easy to describe the state as fundamentally expressing a culture when everyone in the culture is the same or holds the same political or religious values. But government is about managing differences and this is going to be true even of Jewish government.

So this is the primary tension. The tension is between Israel as a modern state and Israel as a continuation of Judaism. In what sense is Israel uniquely Jewish? Well, we could begin with the question of the Jewish people living independently in their own country. How important is it that Jews have a sense of completeness and does this depend on living in certain territory? An Orthodox Jew, although not all strands of orthodoxy, will tell you that the task of completing the Jewish people is dictated by God and an in-tact political system is a means to that end. In fact, the reconstitution of the state of Israel in the biblical and religious sense is a sign of the coming of the Messiah. In the Bible a collection of people make up the nation and they are permanent entity. In this image Israel would become a Torah state that might be an honorable expression of the will of Jews, but it would also be discriminatory not only against non-Jewish groups but include gender and the various intellectual discriminations. To be sure, Israel could create a state of the Jewish people and such a state would struggle in contemporary terms.

We are still confronted with the question of how modern Israel fits into the long tradition of Jewish civilization. And if we decide that Israel is Jewish first then there is the daunting question not of Judaism – which will make adjustments slowly to the modern world – but how Jewish Israel fits into the contemporary culture of justice and fairness for all. How New Digital Technology Encourages Terrorism and Threatens Democracy

digital media and securityThere was a time when surveillance and security concerns did not trample on the rights of individuals or democratic principles because the entire matter was too difficult and cumbersome. In the old days when the threat was only ideological (e.g. communism) security issues were far less immediate and gathering information was a slow and lumbering process. But now there is a marriage of violence and digital technology. It is no accident that the correlation between terrorism and media presence and sophistication is strong and positive. As digital technology has advanced, along with the ease and availability of violence, so has terrorist activity and the technology and security requirements necessary to control it.

The threat to individual rights and democratic processes is always easy to defend when faced with rank violence. Of course we cannot let extremist ideologies and easy violent behavior dictates the political environment. But digital technology allows nonstate actors as well as other participants to engage in violence with ease by historical standards. Again, during the relatively simple period of security issues during the Cold War if an individual were a potential threat to the United States he could be detained or we could even enlist the help of others and subject the individual to legal processes. In the modern digital age the means and techniques of interrogating individuals and gathering information are less compatible with legal principles and offer more options – some of them unpleasant and questionable legally and morally.

In the Cold War if we wanted to learn secrets about somebody someone could be assigned to “tail them” and see what they could learn. This was slow, unreliable, and not a very productive use of resources. It was impossible to have enough people assigned to potential sources of information. Searching your person or your property required legal permission. New digital media can gather vast amounts of information from your cell phone, websites, credit card purchases, etc. The state has the legal right to gather information from organizations and it can all be done by a few people in a single place. Moreover, all of the electronic data about you is potentially more informative and revealing than any information obtainable from a coworker or close friend. Purely human information is fallible; people are not paying attention to what you’re doing, or you forget what you did at a certain time and place. But your cell phone and computer don’t forget. It’s all there in simple searchable form.

In the Cold War there was no technology available for massive data-gathering like collecting phone messages from entire communities. Today, the technology is available along with the software sophistication for massive meta-data collection. In fact, Facebook does the equivalent every day.

The security issues in the modern era are serious because of the easy availability of violence and technology. The security sector of the state measures itself by its ability to prevent incidents and is thus motivated to do more and more, regardless of how far the edges of acceptability are pushed, to ensure that there are no more 9/11s. These conditions threaten our democracy as they push the pendulum more towards the security side of the continuum. Still, surveillance and security are part of any state and targeting an opponent of the state capable of violence is legitimate.

Practical limits and approval from proper chains of authority are the only answer to maintain the balance between security and democracy. But new challenges and interesting questions still are on the horizon. Google and Apple, for example, are planning on encryption devices in new versions of cell phones. Security forces are legitimately concerned that this will make important information even more difficult to obtain. But such devices will strike a blow for privacy and individual rights while maintaining the tension between security and democracy.
