Covering Israel: Western Democratic Traditions and Moral Failings

Times Opinion pageThe Israeli-Palestinian conflict is always here. It continues year after year as populations everywhere grow weary. The other issue that is always with us is the charge of biased news coverage. Large numbers of people will charge, for example, the New York Times with blatant bias and their fury seems to jump from the page. The next day another group will accuse the Times of being the mouthpiece for Israel. You can’t win and you don’t know who to believe. Margaret Sullivan of the New York Times recently expressed similar frustrations in an article called “The Conflict and the Coverage.”

Frustrating and futile as it seems to be, newspapers of quality such as the New York Times must continue to grapple with how they can do better. And they must continue to search for standards that ensure balance, context, and accuracy. Even though we have a tradition of aspiring to objective journalism the public remains ignorant about how journalists actually work, not to mention the difference between “bias” and “perspective.” Moreover it is impossible to write a story from a perspective that matches everyone. But let me suggest to you three good reads on the matter of covering Israel and the Israeli-Palestinian conflict.

The first one we mentioned above is Margaret Sullivan who is the public editor for the New York Times. Sullivan concludes that The Times does everything in its power to be fair and does have a basic worldview that Israel has a right to exist. This assumption puts them at odds with radical critics of Israel such that nothing The Times does will be satisfactory. She makes four suggestions: (1) provide more historical and geopolitical context, (2) improve the engagement between the newspaper and the public so that the public can ask questions and learn more about journalists, (3) improve the coverage of Palestinians, and (4) stop straining for equivalencies. In other words, take a stand when defensible and necessary.

If you want a perspective from a blogger strongly supportive of Israel who corrects biases and misunderstandings then go to “How Not to Report on Israel (and How It Can Be Done Correctly”). You will not find detailed data and argument on the site but you will find the perspective of a cultural native who is tapped into the consciousness of Israel. This is a useful perspective because many journalists covering the Middle East have a modest at best working knowledge of history, culture, language. This may not be true of journalists such as Thomas Friedman but he is an exception as well as an editorial writer which allows him to stay above the fray; that is, he is rarely if ever on the ground reporting facts.

A final reading is from Tablet magazine entitled “An Insider’s Guide to the Most Important Story on Earth.” In this essay a former AP correspondent explains how so much of the reporting fails to understand Israel. Yet the international media is consistent in its reporting and suggests a narrative or an understanding of Israel that is largely misdirected. First, so many media assumes that the Israeli-Palestinian conflict is more important than others where more people die and the politics are more contentious. This “magnification” process often associated with the media is truly operational here. The conflict also garners attention because it takes place in the center of the three Abraham religions – Judaism, Christianity, and Islam – and this infuses it with significance. Secondly, it is simply policy to favor stories that are about violence more than peace and reconciliation. When a political party is elected to government and it seeks a moderate path and contact with the Palestinians the story goes untold. This is true, according to Matti Friedman the author of the Tablet story, because of the pressure to maintain the consistent narrative that has the Palestinians as the underdog seeking a home and historical justice, but Israel as difficult and unmoving as it drifts rightward.

The coverage of Israel has moved from fair and supportive to unfair and critical. And no fair treatment of Israel can ignore either its strong Western democratic traditions or its moral failings. But it is also true that Israel is not a symbol for everything right or wrong, good or evil, solvable and not. The coverage of Israel requires some critical empathy on the part of all sides.

 

 

 

 

 

 

 

 

 

5 Dumb Moments on The Israel-Palestine Conflict

5 dumb moments when it comes to the Israel-Palestinian conflict. At the number 5 spot is Joan Rivers. She claims to know what is going on between Israel and the Palestinians because “she has been there.” I suppose if you can afford to fly to Israel then you will become knowledgeable. All of the nuances of the conflict become clear to you as you relax by the pool at the King David. Of course your credentials are never more evident than when you claim somebody else is not bright enough to understand the issues.

Howard Stern, coming in at number 4, uses the same approach to the discussion which is to claim everyone around him is stupid and doesn’t have the right to speak, attacks easy targets such as Rihanna, and spouts mostly macho stereotypes about Israel or the Palestinians.

Below is a video featuring conservative talk show host Dennis Prager (number 3) and he commits the sin of simple simplicity. Prager stares into the screen with an unemotional tone about how this problem is not so difficult, it all boils down to the fact that “they hate us.” Prager cites the line often attributed to Netanyahu that if the Arabs lay down their arms and announced peace there would be no more war, but if the Jews lay down their arms and announced peace, there would be no more Jews.

This is the “they hate us” theory. It is an emotional shorthand that distills every political disagreement and the entire history of the conflict including the clear political issues into a single emotional outburst. The “they hate us” theory trivializes politics, turns issues that truly demand attention into unsolvable simplicities, and promotes a defeatist sense that nothing will change.

I could not resist an example from Hamas which is just about laughable because it will say anything it needs to at any time regardless of the lie. Of course the segment is not “funny” but it is absurd which makes it funny. This fellow from Hamas actually invoked the blood libel’s from the primitive past. He did it in Arabic probably as a result of speaking different ways to different audiences. Still, to make reference to such silliness is so intellectually embarrassing that I just had to include it.

This Is Senator Gohmert from Texas and he fits the entire stereotype. This is the number 1 funniest and dumbest statement on the Israel Palestine conflict. The poor fellow has his politics, history, and religion confused and it is wrapped around his delightful Texas idiomatic speech.

 

Is This Editorial Cartoon Funny?

Scale Cartoon for Israeli TeenagersPeople enjoy political cartoons. They make for fast iconic processing and cut to the quick of a point. This cartoon by Steve Bell is clearly cynical and anti-Israel. Its essential point is clear enough – that Israel values its own lives greater than that of the Palestinians. An even deeper and more cynical and insensitive interpretation would be that “only” three lives are considered more significant than all of the Palestinians.

But the cartoon does represent the mindset that characterizes the perception of Israel. On the one hand, any culture disproportionally prefers its own people and interpretations of its culture that are favorable. Why wouldn’t an Israeli, or an American, or member of any other culture be at least just a little biased towards its own people and political conditions? But this cartoon doesn’t state an obvious political reality; it’s not a simple statement of support and preference for one’s own that anyone can understand. No, it’s an indictment. It is a charge that Israel considers itself to be superior, that the lives of three teenagers (three coffins draped in an Israeli flag) are considered more important than all the Palestinian suffering.

Political cartoons that are rich in interpretive possibilities lend themselves to multiple issues and implications. This one not only accuses Israel of unfair and biased attitudes about human life but also speaks to the issues of moral superiority and moral equivalence. It accuses Israel of considering themselves to be morally superior, which is why the death of the three teens outweighs the Palestinian experience or the other side of the scale. And even though, as referred to above, this is common enough and true of any political culture in the hands of a cynical cartoonist it becomes an accusation. Moreover, as part of this bias towards one’s own group, there is the matter of moral equivalence or the belief that your own group is equally as justified as any other group. If the killing of the three teenagers was the act of a crazed individual (such as in the case of Baruch Goldstein) then that is different than it being a political act. But if Hamas for example consciously planned to kidnap and kill three Israeli kids coming home from school as part of a political statement, then an aggressive response is justified.

One of the most pernicious aspects of the Israeli-Palestinian conflict is the sense of moral equivalence on both sides. The Palestinians believe they are morally superior because more of them have died, and the Israelis believe they are morally superior because of their developed political culture as well as the conviction that they are a legitimately established state that is surrounded by enemies and simply defending themselves.

Research on political cartoons reports that cartoonists want to expose the system and encourage resistance. They clearly have an agenda, which is fine because that’s their job. But a persistent bias toward one issue is no different than any journalist engaging in conscious and systematic bias with respect to an issue. An editorial cartoonist is particularly adept at exposing hypocrisy and absurdity and these cartoon moments are powerful when there is a consensus recognizing hypocrisy and absurdity. But a cartoonist who simply hammers away portraying his or her own biased political perspective is little more than a journalist hack.

Political cartoons are naturally critical and typically have a sharp cutting-edge humor and insight to them. And this is why we enjoy them. If they subvert those in power and draw attention to the corruption of deep or sacred principles than editorial cartoons are powerful communication forces. A cartoon may not prompt revolution in the streets but it can be and should be oppositional in the most honorable sense. If we laugh or see ourselves in bitter recognition then the cartoon is successful. But propagating an indefensible cultural stereotype aimed at one culture and interpreting that culture through a single lens (the accusation of Israeli moral superiority in this case) moves beyond insightful cartoons into the realm of rank bias.

What Kind of Mentality Kills Teenagers Because They are Jewish or Palestinian? I’ll Tell You What Kind.

You have to be pretty far outside the category of “human” to kidnap three scared teenagers and shoot them in the back of a car. Shoot them for no reason other than they fit the category of “other.” The murder of Naftali Frenkel and Gilad Shaar, both 16, and Eyal Yifrach 19, and the Palestinian Mohamed Abu Khdeir reveals the monstrosity that can arouse itself in humans whenever group membership is highly salient and fueled by powerful beliefs such as religion. Let me explain how framing a conflict can be murderous.

Experts talking to lay people usually make the point that the Israeli-Palestinian conflict is not about religion or culture but land and national rights. It is a conflict between national political movements – Zionism and Palestinian nationalism – and perhaps includes broader Arab nationalism. Framing the conflict this way is actually quite good and beneficial. In addition to the practical implications, describing the conflict as one between two national political movements makes the conflict more amenable to management and resolution with all of the attendant rational and political bargaining. It implies sensible trade-offs and compromise along with future relationships and the positive attitudes and beliefs that will accompany these compromises and future relationships. Each side will broaden its circle of humanity and slowly include more of the other.

But with the integration and the unity government formed between Hamas and Fatah, not to mention the Hamas Charter and its aggressive religious history, we have a powerful religious element introduced. Islamizing the conflict is our worst nightmare and begins from the simple category definition of the conflict as one between two rival religions Islam and Judaism. Or, to put it in even more intractable terms, a conflict between two opposing absolutes. Now attitudes about the other are not subject to rational trade-offs and the anticipation of future relationships. And yes, the conflict can be Judiazed but there are important differences which we will take up at another time. This post is mostly about Islamizing the conflict. I will deal with revenge later.

Turning the conflict into a religious one between Islam and Judaism means you operate with only two categories – the ingroup and the outgroup with all of the biases and mental distortions that demonize and dehumanize the outgroup and wildly exaggerate the truth of the ingroup.

The murderers of these teenagers did not see  human beings, they did not see naïve young boys, and they certainly did not see three individuals who like sports, school, and their friends. No, they saw three Jews or a Palestinian who are all alike; they saw the “other” who was responsible for usurping the holy land; they saw grossly distorted historical monsters who – as the Hamas Charter indicates – were a demonic force on earth, bloodsuckers and the killers of prophets.

And it’s getting worse. As Hamas asserts itself Judaism becomes its primary enemy. The hate and narrowing categories of acceptance will reach hallucinogenic proportions as Jews are described in demonic terms and according to the Hamas Charter are a “corruption on earth.” It will be increasingly easier to kill innocent teenagers because Islamizing the conflict drained them of any remnant of humanity.

The Hamas Charter – and I encourage everyone to read it to fully appreciate the depths of its depravity – relies on the Protocols of the Elders of Zion. The old charges of the Jews controlling everything would be laughable if they were not so consequential. Hamas is not bargaining over land because Palestine is sacred and not subject to division or occupation by anyone else. There will be no discussion of borders, or settlements, or land swaps. Palestine is dar al-Islam (the abode of Islam).

Islamizing the conflict is the worst thing that can happen from a contemporary social science and intergroup conflict point of view. It will increase the distance and differences, and decrease opportunities for positive contact even more than they are. As the two groups retreat into their own worlds and formulate their psychological and communicative categories such formulations will be increasingly based on misinformation, distortions, historical inaccuracies, stereotypes, and emotions until the two groups retreat to their respective corners each having drained the other of even the slightest consideration. At that point it becomes easy to murder teenagers.

 

 

The Reptilian Sensuality of Hate

The noted cognitive scientist and Nobel Prize winner Daniel Kahneman introduced the concepts of System 1 and System 2 or fast and slow thinking. System 1 is fast, instinctive, and emotional. System 2 is slower, logical, and deliberative. System 2 came later in our evolutionary development. System 1 thinking is intuitive and uses quick judgments that we rely on for most decisions. It is also the process that leads to far greater biases in judgment. System 2, our more deliberative thought processes, can be used to dampen the negative effects of our intuitive judgments. System 1 or fast thinking is reptilian and automatic. It has evolved from deep in our evolutionary history. So we respond quickly and easily to sexual associations and danger. System 2 is thoughtful and cognitive. It requires slower thinking and patience.

The experience of hate is I think a System 1 cognitive process but we often try to treat it with System 2 solutions. In other words, the bigot, anti-Semite, and the racist are typically confronted with System 2 rational thinking as if the person is simply experiencing unjustifiable beliefs and misinformation. We try to change the person or educate him by presenting facts, correcting errors, and revealing logical inconsistencies. Curiously, we are dumbfounded and dismayed when this doesn’t work. When our attempt to reason the other person into correct thinking is useless we are chagrined.

The truth is that bigots and racists and anti-Semite’s don’t want to hear it. They are immune to the closed fist of logic that characterizes reasoning. Also, even though it’s a little bit counterintuitive, these people enjoy the experience of hating. It’s a powerful biologically-based experience of information that doesn’t require much from them and is sensually pleasing psychologically. The System 1 experience of emotional engagement for the racist and anti-Semite is fun! The quick and automatic conclusions of System 1 thinking are enjoyable and require little of the hater.

The person’s beliefs are firmly established and foundational to the experience of hating. There’s no questioning or insecurity. Anti-Semites stand sure in their beliefs and the power and pleasures of self-righteousness, condemnation of others, and sense of intense kinship with those who think like them is climactic in its joy.

Just look at the joys of hating:

  1. That anti-Semite gets to compare Jews to Nazis. What an orgiastic pleasure it is to take the group you hate most (Jews) and compare them to the great symbol of evil Nazis. Hatred is a purifying experience and perhaps the height of its titillating pleasure is the sense of superiority it confers on one. The bully, the self-righteous, the judgmental, and the ignorant are all soldiers in this army of those who feel superior. The expressions of their beliefs are immediate and instinctual. And since they have little cognitive analytic sensibility and are incapable of genuine information processing, they don’t even see themselves as anti-Semitic.
  2. The racist who feels his group is superior transcends the pleasures of superiority and can think of himself as “morally” purified. Everywhere he looks he sees evidence – the confirmation hypothesis at work a System 1 heuristic – of his group’s moral clarity. The history and traditions of the outgroup are the subject of propaganda and deceit as any “good” in the outgroup is automatically attributed to the environment rather than the group thus maintaining the racist’s own sense of purity.
  3. The instinctual and exaggerated language of the hater quickly categorizes the other and relieves him of the burden of real moral scrupulousness. So one can accuse Israel of violation of human rights or colonialism without doing the hard analytical work of defining and understanding these ideas. These pleasures extend to the Westerner who hates Islam as well. His sense of political supremacy and rectitude produces the same gut feeling that Islam is backward and tribal, thus reproducing his own moral superiority.

Deliberative and thoughtful exchange about others is slow and plodding. It requires correction and revisiting of attitudes and beliefs that must be modified or discarded. The scrupulous attention to cognitive errors and misinformation is evolutionarily new and we are not yet so good at it, especially when deliberation has to compete with the reptilian joys of hate.

Movie Stars, War Criminals, and Criticism of Israel

Once again we are confronted with monstrous contradictions, ideological ignorance as well as inconsistency, and an oppressive and unfair singling out of one group (Israel) that certainly smells of anti-Semitism if nothing else. It’s another one of those moments when the world seems less than sane. Israel a vibrant democratic market economy surrounded by less developed political cultures is targeted by a fringe anti-Israel movement called BDS or boycott, divestment, and sanction.

Daniel Schwammenthal wrote in The Wall Street Journal Europe about how the BDS crowd  might as well label Scarlett Johansson a war criminal of all things because she works for and supports SodaStream a highly successful sophisticated soft drink company. SodaStream is a model of coexistence, sustainability, peace, and corporate responsibility. They make a tasty fizzy drink and the company is operated by the Israelis and Palestinians together including Jews, Muslims, Christians, and Druze. The company is known for its environmental sensitivity and complete equality between Israelis and Israeli Arabs. There are no discrepancies in compensation and the Arab employees average more income than other Israeli Arabs. Again, the factory is an example of cooperation and what future relations could look like between Israeli Arabs and Israelis.

SodaStream has numerous factories but one of them is in the West Bank. That was all it would take for BDS to get fired up and target Scarlett Johansson and Sodastream as war criminals and violators of human rights. Never mind that if Israel is going to create factories and jobs that include Israeli Arabs than the West Bank is probably going to be implicated. I’m sure BDS’s slick public relations arm was drooling at the opportunity to use Ms. Johansson’s celebrity to magnify their own media presence.

Never mind again that this is pseudo-activism designed to keep pressure on Israel along with a constant flow of criticism without paying any attention whatsoever to issues and analysis. The location of the factory would probably end up in that portion of what is now the West Bank that will be the new state of Palestine – someday one hopes. Additionally, the economic infusion and stimulation provided by SodaStream is not insignificant and makes for considerable economic benefits to the local community. It seems as though BDS is more interested in boycotting the factory and subjecting it to inflamed media criticism than it is the well-being of the 500 Palestinians and their families that work in the factory.

But BDS must be taken seriously because they have convinced more than a few governments and organizations to withdraw investments from Israel. The EU is on the verge of preventing funding that benefits anything related to the West Bank. The pressures on Israeli banks that have relationships with settlements is preventing EU investment money from helping various communities. Once again sanity seems to elude these people and their organizations. It will not be long until Iran is one screw turn away from a nuclear weapon but the sanctions imposed on them don’t seem to be very bothersome. Democratic freedoms of all sorts including gay rights struggle amidst Israel’s neighbors but the EU turns a blind eye. Mahmoud Abbas continues to pay salaries and ignore terrorism.

And all this time the EU continues to support Palestinian communities even though their record of development is poor. They support the Palestinian right to ignore serious peace treaty attempts and encourage them in numerous unproductive ways. Everyone knows, for example, that some sort of compromise is going to have to take place in which Israel keeps selected settlements in exchange for giving up others. Moreover, there will have to be adjustments and compromises on all sorts of issues pertaining to refugees, borders, and the definition of each state. And, yes, Israel too must make some changes, but the EU does not work with Palestinians in a pragmatic manner designed to move them toward solutions. The EU does not communicate or use its position as an honest broker to properly direct Palestinian attention.

Ariel Sharon: Tough Guy

For many people interspersed throughout the politics of the Middle East defending Ariel Sharon is an impossible task. Even bypassing for the moment those who considered him a “war criminal” and an aggressive and narrow minded defender of settlements, Sharon attracts a lot of emotional attention. He is easy to demonize and has been treated with more than his share of abuse and vitriol. He has been portrayed with swastikas and Nazi symbols of all sorts. Characterizing him as a hook-nosed version of Fagan or Shylock is routine for many media outlets.

I accept that Sharon was a tough guy who was a staunch defender of his country and took little reproach from anyone. But a closer look at historical events reveals that he’s been treated pretty unfairly. Again, I would not deny that Sharon was willing to do what he considered necessary but it is interesting to note how the truth or any justifiable interpretation about Sharon has drifted over time. There are three occurrences most associated with Sharon’s reputation for violence. They are the attack on the village Qibya, the second intifada, and the attack on Sabra and Shatila refugee camps. Let’s strike up a little history lesson.

In 1953 Sharon formed a military unit that carried out attacks on Arab villages in retribution for the murder of Israelis. In the village of Qibya he and his unit blew up houses and killed 69 people. Most reports describe this as a mistake and certainly not part of Israeli policy. The attack on Qibya was condemned by Israeli authorities. Moreover describing what Sharon and his unit did as reprisals implies that this was government policy and uncontrolled violence. At the time Israel was responding to the fedayeen who were terrorists no different than today’s terrorists. Israel had a right to defend itself. But the forces around the Sharon’s violent image were building and the Qibya incident simply laid the foundation for future charges.

The Sabra and Shatila incident is most associated with Sharon’s reputation for violence and aggressive reprisal. Sabra and Shatila were Palestinian refugee camps that were the home to various terrorist groups. Those who are truly ignorant of the facts believe Sharon and the Israelis massacred hundreds of Palestinian refugees. But, of course, it was the Lebanese Christian Phalangist militia who carried out the massacre. It was considered revenge killing for the assassination of the Lebanese president in a car bomb. Still, Sharon was blamed for “letting it happen.” Sharon had allowed the Phalange to enter the camp because they were supposed to be administrative changes of sorts. Sharon made mistakes and probably should’ve known what sort of violence was about to take place when the Phalange entered the camp. But it remains the case that he was regularly defamed and treated in a very discriminatory manner over the years by a constant drumbeat claiming that he “intended” to kill civilians.

Finally, Sharon was blamed for an intense outburst of violence in the year 2000 because he visited the Temple Mount. This was described as highly provocative and sparking the Palestinians anger because of the holy nature of the Temple Mount. Of course, the Temple Mount is equally as holy to Jews as it is to Muslims and even from a legal administrative standpoint Sharon had a “right” to go there. But, it is true enough, that Sharon visiting the Temple Mount was going to be extremely provocative and one wishes he had exercised more discretion. Yet again, Sharon was painted with a broad brush blaming him for the entire Second Intifada. More than a few Palestinians later explained that the Intifada had been planned for some time and that the violence resulting from Sharon’s visit could have been stopped by the Palestinians at any time. Arafat was more interested in provoking the Israelis than anything else.

Ariel Sharon was a magnet for misdirection and misinterpretation of issues. The reporting about him was often strongly biased and never missed a chance to blame him for something. But even though Sharon supported settlement development and was the father of many current Israeli problems, he will also be remembered in history as one of the “fathers” of the state of Israel.

Academic Boycotts Are Damaging, Anti-Intellectual, and Political Posing

There is truly little more distasteful than boycotting academic institutions for questionable political reasons. I mean if any organization is committed to problem-solving, analysis, and understanding it is academia. The American Studies Association (ASA) is an insignificant but highly politicized minor academic organization that is regularly critical of the United States. Last November the ASA was manipulated by an anti-Israel organization into supporting a resolution to boycott Israeli academic institutions. The ASA has about 5000 members and approximately 16% of them voted. A majority of that biased 16% voted in favor of the resolution and it technically passed. Additional details are available at Scholars for Peace in the Middle East. For now, let’s look a little more closely at what happened.

Who is the American Studies Association?

The ASA focuses on the study of American culture in general but with a strong anti-American sentiment. On the website you can find numerous resolutions critical of the US and imbalance with respect to the consideration of many political issues.

What is the justification for this resolution according to ASA?

The basic argument is that Israeli academic institutions are part of the system that discriminates against Palestinians. Moreover the playing field between the Israelis and the Palestinians is unequal because academic freedom is denied to Palestinians. And finally, Israeli universities are part of state policies that discriminate against Palestinians. The resolution claims not to discriminate against individual scholars engaged in research. The ASA asserts that this resolution is a form of social justice.

What has been the response to the resolution?

The response has been overwhelmingly negative with many of university presidents and leaders calling for the rejection of the boycott and for the resolution to be rescinded. Moreover, the ASA is a tax-exempt academic organization but such exemptions are denied if an organization is blatantly political. Lawyers are beginning to work on removing the tax-exempt status of the ASA. Lee Bollinger’s statement opposing the boycott appears here.

Still, the media coverage of the boycott has been strong and successful at raising the issue in the consciousness of most people. Many of the distinguished newspapers across the country have been critical of the ASA and these criticisms range from the left (e.g. The Nation) to the right (Commentary). Some criticisms from the left have claimed that the ASA resolution will weaken other causes, and some from the right simply defend Israel’s right to defend itself and question the political and legal challenges in the West Bank. The president of the Palestinian Authority Mahmud Abbas also rejects boycotts against Israel except in certain instances, and these refer to particular products, beyond the green line. The ASA appears to be stunned by the negative reaction and has begun manipulating its website and adopting a stance designed to minimize the damage.

The ASA has shown itself to be counter to the traditions of academic freedom and even potentially dangerous to inquiry and progress. If the resolution has any effect at all it will probably be to damage and make more difficult the work of just those individuals most able to work toward the resolution of the problems between Israelis and Palestinians. Resolutions such as these are typically political posing designed to attract attention rather than solve problems. And although attracting attention is a key component of the political communication process, the Israeli-Palestinian conflict is beyond such simplicities and in need of serious attention by serious scholars – not the kind of attention that comes from the safe stances of fashionable progressives who make pronouncements but don’t “get in the fight.”

 

Just a Little More on Israel As a Jewish State

In this post I want to spend just a little bit of time dealing with a few more specific and down-to-earth issues with respect to Israel being a “Jewish” state. I received my share of responses last week ranging from those who thought it was just another slap in the face of Palestinians, to those who are sure the state will become a theocracy and oppressive. Below I enumerate key issues and respond directly. I will avoid the historical arguments about the legitimacy or illegitimacy of the establishment of the state and what transpired in 1948. Rather, I focus on more mundane issues.

1. Many people get depressed about Israel as it fumbles forward increasingly divided by religion, secularity, and politics. The truth is that Israel is already ahead of most with respect to democracy. It has not made peace yet but that is a relational concept that requires help from the other side. Israel is currently the “state of the Jews.”

2. All Israel needs to do is establish a state that tilts toward the protection and development of Jewish life, culture, and religion. Israel will always be diverse but groups will always have a right to their own identity and protection under the law as long as they do not actively advocate for the destruction of the Jewish state. All groups have a right to advocate for their interests – even the majority group as long as it does it within democratic principles.

3. So, what do you do about an institution such as education? The role of an educational institution, especially public education, has always been to promote Jewish identity and citizenship in the public schools. But why is this any different than in the United States where schools promote American cultural values. And being socialized into a community through the public education system is not a mindless activity; there is no reason that the Jewish education cannot expose students to the conflicts and contradictions of this society as well as others.

4. The law of return is often cited as a discriminatory act that allows all Jews to settle in Israel but not those Arabs from earlier generations who lost property in the war or had it taken from them. The right of return could make it possible for Jews to return but not guarantee their actual return. That was always up to individuals and families. A significant ingathering of a particular group is a clear demonstration of a population’s readiness to establish formal legitimacy. The state fulfills the legitimate aims of a large group of people.

5. What about things like national symbols such as the flag of the state of Israel, the Star of David. Such a flag certainly does not represent symbolically in any way the Arab minority population. Still, many countries have religious symbols on flags and the Star of David would have to remain as a significant symbol for Israel and the Jewish people.

6.Or, even more divisive and impossible would be the singing of Hatikva the Israeli national anthem. The state of Israel cannot be neutral on these matters and still claim its Jewish identity. But it is also true that the obligations to democracy require as much neutrality as possible. But solutions to these things are possible. Gavison suggests, and I agree, that a second national anthem could be written acceptable to the Arab community. We would hope that one day the two sides might listen politely to each anthem.

7. Or what about the national calendar including the recognition and observance of holidays, public festivals, and school closings? This too is a solvable problem. Schools and institutions could be organized around the holidays of both significant groups. Jews are off during “Christmas” break in the United States which is based on a Christian calendar.

We should remember that a Jewish state creates conditions for a powerful cultural Jewish life. Works of literature, philosophy, art, and science rooted in Jewish life and tradition will have the opportunity to flourish. All ethnoreligious conflicts must strike a deliberative balance between what divides them and their necessary interdependence. Doing this successfully requires communication and democratic conditions, both of which continue on striking a homeostatic balance.

 

How Israel Can Be “Jewish”

This is a big and controversial issue and I will not satisfy most people. Moreover, it is steeped in serious issues related to political theory, culture, philosophy, and the law. Better minds than mine have grappled with this issue. Still, I’m going to make a case. I’m going to make a case for two reasons: one, I believe a defensible case can be made. And, secondly, I believe it is important to make the case because Israel is clearly deserving but vulnerable and its political status is important for its long-term prospects. Israel is besieged on all sides by those who see it as illegitimate and conceived in sin (a Christian image). For these reasons – along with historical and cultural connections to the land as well as the ethnopolitical character of the people –it is important to establish Israel as a Jewish state. The single best reading here is by Ruth Gavison titled “The Jews Right to Statehood: A Defense.”

For starters, a Torah state run by Orthodox rabbis is not only undesirable but not defensible. A legitimately recognized Jewish state must be as democratic as possible and founded on human rights. It’s important to recognize that Israel cannot be a liberal democracy in the same vein as the United States. I’ve made this argument before but it is simple enough: if Israel is going to be even slightly favorable towards Jewish particularity than it is going to privilege one group sometimes at the expense of others. We have to remember that democracy is a continuum.

If some secular professor representing the universal values of the contemporary left believes that any state organized around ethnicity or religion is a remnant of ancient tribalism and thus undeveloped, then I say “so what?” The type of state I have in mind is not a theocracy. It is a state that privatizes much of religion but simply works to fulfill, support, and express the religious culture of Judaism. For example, Israel has no religious test for its highest offices of president or prime minister. The president or Prime Minister does not have to be Jewish in the religious sense he or she just has to have the fulfillment of the Jewish state in mind. They have to accept the founding principles of doing nothing to interfere with the Jewish character of the state.

We can dispense with the criticism of Israel as a political entity from Muslim states quite easily. Many of them (Oman, Qatar, Kuwait) have Islam as the religion of the state and laws requiring public officials to be Muslims. This is fine, it is a principled point but certainly lends hypocrisy to the claim that Israel should be multicultural or one secular state. Their refusal to acknowledge Israel as a Jewish state is not a political or philosophical argument, it is a charged political ideal based in their refusal to make peace with Israel.

And there are examples of secular states with religious ties that operate quite well. I would compare something proposed for Israel to that of Denmark. In Denmark the Constitution recognizes “the Evangelical Lutheran Church” as the established Church of Denmark. The only requisite is that the political leadership in Denmark do nothing to interfere with the established church.

Israel must continue to establish justification on moral universal grounds as much as possible because this appeals to most of its own people who feel the power of the Zionist project but are not particularly religious. Gavison makes the interesting point that the more Israel argues on the basis of universal values the more the Palestinians will follow suit rather than claiming ownership based on the sanctity of Muslim lands. The state of Israel will be a contestatory political system constantly engaging in interaction designed to balance human rights with its Jewish nature. This is consistent with all democracies who rely more on argument and deliberation than ideology.

I reiterate that it will be impossible for Israel to be absolutely neutral with regard to cultural, ethnic, and religious issues. There will be differences in civic equality. But these differences do not have to be fatal. It is still possible to have a democratic Jewish state that respects the rights of citizens – and certainly allows them to engage in their own religion in the same way as the United States does not interfere with religious practice as long as it is in the private sphere – and still represents a national identity.

So for now, the state I am imagining is not completely neutral, has an official language that is Hebrew, a calendar that marks Jewish time (including Shabbat ofcourse), and puts forth a public culture that is Jewish. The public sphere will be important in the Jewish state because that is the context for contestation with respect to issues that affect the public in general. People will be able to practice Judaism or any religion but the management and compromise will come in the public sphere when one person’s rights have to be balanced against another’s.

The state will be as democratic as possible and proudly Jewish.
